American Children's Cancer Association Florida Dream House Raffle

Overview

Raffle Rules:

American Children's Cancer Association, Inc. ("ACCA"), a nonprofit corporation and tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting the Lighthouse Point Florida House Raffle ("Raffle") located at 2840 NE 48TH ST Lighthouse Point, FL 33064, to raise funds for its ongoing charitable activities and purposes. The rules ("Rules") of the Raffle, set forth below, govern the Raffle, award of prizes, and participation in the Raffle. ACCA is a registered charity with the Florida Attorney General.

These Rules bind every person ("Ticket Holder") who buys or holds a Raffle ticket. By purchasing or holding a ticket, each Ticket Holder agrees (a) to be bound by these Rules and (b) that ACCA’s interpretation and application of these Rules is conclusive and final.

BY ENTERING THIS RAFFLE, ENTRANTS ACCEPT AND AGREE (1) TO BE BOUND BY ALL THE RULES, LIMITATIONS AND RESTRICTIONS SET FORTH HERE AND (2) THAT THEIR NAMES AND/OR LIKENESSES MAY BE DISCLOSED TO AND USED BY THE NEWS MEDIA AND MAY OTHERWISE BE USED BY ACCA FOR PUBLICITY PURPOSES AND IN LISTS OF PRIZE WINNERS TO BE ANNOUNCED ON THE ACCA RAFFLE WEBSITE. OTHER RULES AND REGULATIONS MAY APPLY. ACCA’S INTERPRETATION AND APPLICATION OF THE RULES AND REGULATIONS SHALL BE FINAL.

BY ENTERING THIS RAFFLE, EACH PARTICIPANT RELEASES ACCA, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, AND EACH WINNER AGREES TO INDEMNIFY AND HOLD ACCA HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND RISING IN CONNECTION WITH OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

Only one Eligible Ticket Purchaser (as defined below in the "Eligibility" section of these Rules) may purchase a ticket. This means, (a) one name per ticket and (b) one purchaser per ticket. An Eligible Ticket Purchaser may designate another person a Ticket Holder. If a ticket names more than one person as a Ticket Holder and that ticket is a winning ticket, then ACCA will (a) deem the person named first on the ticket as the Ticket Holder, (b) declare the first person named on the ticket as the winner, and (c) award the prize to the first person named on the ticket. In such case, the division of the prize shall be the sole responsibility of the first person named on the ticket. Once ACCA awards the prize to the first person named on a ticket, ACCA will have no further duties or obligations with respect to the division of the prize and all persons named on a ticket as Ticket Holders release ACCA from all claims relating to the award of the prize or its division among other persons on a ticket named as Ticket Holders. The IRS has taken the position that amounts paid for chances in Raffles, lotteries or similar drawings for valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions.

To be eligible to purchase a ticket, a ticket purchaser (an "Eligible Ticket Purchaser") must (a) be at least 18 years old at the time of purchase, (b) be a U.S. resident physically residing in the United States or District of Columbia.

A person cannot be an Eligible Ticket Purchaser or a Ticket Holder if such person or holder is a person (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List") or under any statute or executive order or (b) who is acting, directly or indirectly, for or on behalf of any such person.

Tickets may be purchased as gifts for people under 18 years of age ("minors"), but minors may not purchase tickets. If a ticket is purchased by an Eligible Ticket Purchaser who designates a minor or person otherwise under a legal incapacity as the Ticket Holder, then, if that ticket is a winning ticket, then ACCA reserves the right to require appropriate acknowledgements, approvals, and consents of such person's conservator, guardian, or parent as a condition to the award of the prize to such person. The following individuals, and immediate family members (defined as spouse, IRS dependent, or step- or biological mother, father, sister, brother, daughter, son, friend or associate) of, or who reside in the same household as, any person in any of the following categories, are not eligible to participate: ACCA's employees, any person engaged in the development, production or distribution of materials or prize supply for the raffle. This is not a lottery, this is drawing by chance. All applicable federal, state, and local laws and regulations apply. ACCA is obligated to report the value of the prize to tax authorities as income.

ACCA reserves the right to require reasonable evidence of the eligibility of an Eligible Ticket Purchaser or Ticket Holder at any time and to void any ticket sold to a person who does not meet the eligibility requirements or who is precluded by applicable law from holding a ticket or participating in a raffle.

How to Purchase Tickets

Eligible Ticket Purchasers may purchase the $80.00 suggested donation (no purchase necessary) Raffle tickets online at www.give2kids.com or make a ticket reservation by calling toll-free 800-448-3254. At the time of purchase, Eligible Ticket Purchasers must provide their name, address, email, phone number, credit card number, credit card security code and expiration date, and such other information as ACCA may require. Eligible Ticket Purchasers may also purchase tickets by mailing the filled in ticket entry form to American Children's Cancer Association 1200 Federal Highway suite 200 Boca Raton, FL 33432. All entries must include payment by check, money order, credit card or PayPal.

Tickets will be distributed and ticket numbers will be assigned in the order that payment is received. All payments will be deposited upon receipt. ACCA reserves the right to reject any entry form that it deems defective, illegible, ineligible, or submitted without "good funds."

In accordance with Applicable Law, ACCA will not mail Raffle tickets to Ticket Holders. ACCA will mail or email unofficial raffle tickets as receipts for ticket purchases to the person named on each Raffle ticket entry form within one week of purchase. Hard copies of official tickets are available upon request. To win a prize, Ticket Holders do not need (a) to possess a hard copy of a Raffle ticket or a receipt in order to win and (b) do not need to be present at a drawing.

Each Raffle ticket purchased before a deadline qualifies for all future drawings for which that ticket is eligible. Each winner of a special Early Bird Drawing will be automatically re-entered in all subsequent drawings for which that ticket is eligible.

All Raffle ticket sales are final. ACCA will make no refunds except under the following circumstances: ACCA will return any payment that ACCA receives after (a) it has sold 37,500 tickets or (b) after the Final Ticket Purchase Deadline. No other refunds are available except at the discretion of ACCA. ACCA assumes no responsibility for lost, late, misdirected, or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

The Grand Prize Drawing for the Raffle will take place on April 15, 2014 ("Grand Prize Drawing Date"). The final ticket purchase deadline for entry is March 31, 2014 ("Final Ticket Purchase Deadline"). Tickets may sell out before that time. Only 37,500 tickets will be sold. As set forth in the "Prizes" section below, the number of tickets sold determines the Grand Prize that ACCA will award. If fewer tickets are sold, your chances of winning the Grand Prize and other prizes improve. The drawing is open to the public, but the winner need not be present to win.

If the Grand Prize House (House) is chosen as the prize, the Grand Prize winner shall assume all fees, local, state and federal taxes (including but not limited to income taxes based on the value of the House), financing costs (including, but not limited to, closing costs, title insurance, and transfer tax and fees) which must be paid when the House is transferred to the winner. Likewise, there are federal taxes and there may be state and/or local tax consequences if the winner selects the alternate cash prize. These consequences may apply to other prizes as well. ACCA takes no responsibility for any tax liabilities or costs. Consult your tax advisor. This offer is void where prohibited by law, and all federal, state and local laws and regulations apply.

ACCA will draw at random and determine winning tickets under the supervision of ACCA’s certified games manager(s) or independent certified accountant. If the Grand Prize winner cannot be located within 10 days of the raffles conclusion, after making a reasonable attempt to make contact through the information provided at the time of purchasing the Raffle ticket, such winner will be deemed to have elected the onetime cash alternate prize and another winner will not be selected for such prize. In order to collect his or her prize, a Raffle ticket winner must sign and deliver to ACCA: (a) a sworn affidavit of eligibility in accordance with these Rules and applicable law, including without limitation that he or she is at least 18 years old at the time he or she purchased the winning Raffle ticket; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; (c) proof of identity in forms satisfactory to the ACCA showing that the person claiming the prize is the same person who is named on the winning Raffle ticket. Winners of prizes of $1,000 or more may be required to submit a W-2G, Form 5754 or similar tax form (provided by ACCA) for tax withholding purposes.

Selection of Winners:

The American Children's Cancer Association Luxurious Lighthouse Point Florida Dream Home drawing will be held on April 15, 2014, from all eligible Raffle tickets. Winners need not be present to win. ACCA will conduct the Early Bird drawings on January 31, 2014 (Early Bird Drawing 1), February 28, 2014 (Early Bird Drawing 2). The "1 out of every 150 wins" drawing will take place after every 150th ticket is sold, where 1 out of every 150 4) The 1 out of every 50 wins drawing will take place after every 50th ticket is sold, will be randomly picked and those winners will be contacted and listed on the winners page. The "Refer-a-friend" drawing will also take place on the same date as the grand prize. All winners will be notified by email, mail and phone as well as being listed on the ACCA raffle web page. All winning tickets from 1 out of every 150 wins, 1 out of every 50 wins and Early Bird drawings will be re-entered and will be eligible the Grand Prize Drawing. The Refer-a-Friend Drawing is for every person who refers a friend who purchases a Raffle ticket. For every Eligible Ticket Purchaser who purchases a ticket and provides a referring party’s name, a ticket containing the referrer’s name will be entered in the Drawing. The referrer is required to purchase at least one ticket to be included in the Refer-A-Friend Drawing. All drawings are open to the public, but winners need not be present to win. All prizes will be awarded at the end of the raffle.

Winning Odds:

The odds of winning one or more prizes will depend on the number of tickets sold. If ACCA sells all 37,500 tickets, the odds of winning the Grand Prize are 1 in 37,500. The chance of winning the Grand Prize, Early Bird Prizes and Refer-a-Friend prizes will vary based upon the number of tickets sold, and if ACCA sells less than 37,500 tickets or adds additional drawings or prizes, the chance of winning a prize will increase. The odds in winning the "1 out of every 150 wins" is 1 in 150 and the odds of winning the "1 out of every 50 wins" is 1 in 50.

FIRST EARLY DRAWING PRIZE: Purchase Deadline: January 31, 2014. Drawing: February 1, 2014. Winner gets a choice of a 2014 Chevrolet Corvette Coupe or 50,000 in cash..

SECOND EARLY DRAWING PRIZE: Purchase Deadline: February 28, 2014. Drawing: March 1, 2014. The Winner gets a chive of a 2013 Cadillac Escalade Base Sport Utility or 50,000 in cash.

REFER-A-FRIEND: Entry Deadline: March 31, 2014. Drawing: April 15, 2014. The Winner gets a choice of 1) IMac Computer 27-inch 3.2GH 3.2GHz quad-core Intel Core i5 Turbo Boost up to 3.6GHz 8GB (two 4GB) memory 1TB hard drive NVIDIA GeForce GTX 675MX with 1GB or 2,000 in cash.

GRAND PRIZE DRAWING: Purchase Deadline: March 31, 2014. Drawing: April 15, 2014. The Winner will chose from 1) 2,100,000 Florida Dream home or 1,600,000 cash payment.

1 OUT OF EVERY 150 WINS DRAWING PRIZES: Drawing will be held after every 150th ticket is sold and The Winner gets 1000 cash prize. All tickets in every 150th ticket group will be re-entered into any current Early Bird Drawing and Grand Prize Drawing. Tickets that have already been entered into a "1 out of every 150 wins" drawing, will not be re-entered into another "1 out of every 150 wins" drawing.

1 OUT OF EVERY 50 WINS DRAWING PRIZE: Drawing will be held after every 50th ticket is sold and The Winner gets 500 Cash. All tickets in every 50th ticket group will be re-entered into any current "1 out of every 150 wins (one time)", Early Bird Drawing and Grand Prize Drawing. Tickets that have already been entered into a "1 out of every 50 wins" drawing, will not be re-entered into another "1 out of every 50 wins" drawing.
